For over 10 years Bell Ingram has been assisting telecom operators to secure wayleaves for telecom cables and leasing sites for telecom masts, from initial site inspection and referencing to client and landowner liaison.

When electricity companies began wrapping fibre optic cables around the earth wires on their overhead power lines, Bell Ingram were contracted by National Grid (Energis Project) and other operators in the north of England and Scotland, to secure Telecoms Wayleaves from landowners and occupiers. For many years Bell Ingram has also been advising BT, undertaking equipment surveys and assisting with wayleave negotiations.

The Company also provides expert witnesses and advice on telecoms wayleaves and easements. For telecoms masts, we have negotiated terms for Leases and rent reviews for a number of operators, including Orange. We have also prepared cases for
arbitration.

Telecom Cables and Wayleaving

We establish details of land ownership along proposed cable routes and make initial approaches to landowners, obtaining contact details and agreeing the final route.

We prepare wayleave or consent documents, visit landowners and secure signed consents for overhead or underground cables, including above ground equipment. We also provide advice during the construction and operational phases, including drainage and land reinstatement, landowner liaison and negotiation of compensation claims.

With a substantial knowledge of the history of telecommunication wayleave and easement rates and of standard terms offered by telecom operators, we can secure agreements with landowners without prolonged negotiations.

For a new site we will establish ownership details, make an initial approach to the owner and negotiate terms for a secure long term letting.

Terms for leases will include rights for services, terms for rent reviews, site sharing, equipment rights and terminating the lease.

Bell Ingram is also experienced in negotiating open market rent reviews and agreeing terms and concluding temporary agreements for renewals of leases that are time expired.

Familiarity with the various Telecoms Acts, an understanding of the terms of telecoms leases and a comprehensive knowledge of current market rates is essential in what is now a very challenging market.
